On Tuesday, June 15, 2021, Tevin Biles-Thomas, the brother of Olympic gold champion Simone Biles, was cleared of the murder accusations leveled against him.
The case was deemed a mistrial in May, and he was acquitted in a retrial this week. Judge Joan Synenberg of Ohio’s Cuyahoga County Common Pleas Court granted a Rule 29 request in the acquittal, claiming a lack of evidence, according to CNN. In a triple homicide incident in Cleveland in 2018, Biles-Thomas was charged with murder, voluntary manslaughter, and felony assault. The mother of one of the victims accosted him in the courtroom after his acquittal.
“He assassinated my child! You’re aware that he murdered my child!” Before being restrained by authorities, the woman allegedly yelled and charged at Biles-Thomas. Later, Biles-Thomas‘ lawyer, Joseph Patituce, remarked that he sympathizes with the mother’s pain.
Simone Biles, his sister, has remained silent since his acquittal.

When the infamous Airbnb homicide occurred on New Year’s Eve in 2018, Biles-Thomas was 24 years old. At the time, he was a US Army officer on active service.
The tragic shooting happened on New Year’s Eve, just before midnight, at an Airbnb rental flat above a pizza business in Cleveland’s Brooklyn Center district. Uninvited visitors arrived at a party in the flat, according to investigators, and a brawl ensued. Devaughn Gibson, 23, DelVaunte Johnson, 19, and Toshon Banks, 21, were killed after Simone Biles’ brother allegedly opened fire on the gathering.
A 21-year-old man who was shot in the back of the head and a 23-year-old woman who was wounded in the arm was also hurt in the incident. Officials claimed the gunman or shooters had fled by the time they arrived, and no firearms had been recovered.
Nine months later, on August 29, 2019, Biles-Thomas was apprehended in Fort Stewart, Georgia. He entered a not guilty plea to the accusations leveled against him.
His lawyer, Joseph Patituce, made a statement following his acquittal on the charges, saying, “This was a horrible tragedy, three families lost three family members and you know, absolutely horrific. So, we understand emotions were running high. But today, Tevin Biles was vindicated, what he’s waited to get for the last two and half years……because he is frankly innocent of these charges and today we were able to see that the state had absolutely no evidence that he was guilty of this offense.”
